Terms of Service

Introduction

Jester Software LLC, doing business as Gabagoolio (“Gabagoolio,” “we,” “our,” or “us”), operates gabagoolio.com, a job board with a map (the “Service”). By using the Service you agree to these Terms of Service (“Terms”). The Privacy Policy describes how your personal information is handled.

Definitions

  • “Content” means the resumes, cover letters, transcripts and other documents, the My details and eligibility answers, the notes and feedback, and any other information you provide to the Service.
  • “Listings” means the job postings, rental and other housing listings, housing figures, crime figures and other area information the Service obtains from third parties and shows to you.

Account Registration

To use the board you must sign in with Google, or with a sign-in code where we provide one, and be at least 16. A new account also needs the board’s access password. If you are under 18, you must have a parent’s or guardian’s permission. Keep your details accurate. You are responsible for activity under your account.

Use of the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your own job and housing search. You agree not to:

  • Break the law or infringe anyone’s rights.
  • Submit false or misleading information, or apply in another person’s name without their authority.
  • Scrape, crawl or harvest Listings or any other data from the Service, or access it with automated scripts, bots, scrapers or similar tools.
  • Attempt unauthorized access to any part of the Service.
  • Interfere with or disrupt the Service or its supporting infrastructure.
  • Reverse engineer, decompile, or disassemble any aspect of the Service.

Content and Applications

User Content: You retain ownership of all Content you submit. By submitting Content, you grant Gabagoolio a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display the Content only to provide and improve the Service, including submitting it with job applications you direct.

Applications: When you direct the Service to apply for a job (an “Application”), you authorize Gabagoolio to submit your Content to that employer through its application form or hiring system and to answer the form’s questions from your Content. The Service uses an AI model to read each form and choose answers from your Content, and it can make mistakes. You authorize the Service to accept an employer’s terms, confirm the statements the employer’s form requires (for example, that your answers are true), and enter your typed name as your signature on Applications you direct. You are responsible for the accuracy and completeness of the Content you provide and of the answers submitted from it. Once an Application is submitted it is held by the employer, and Gabagoolio cannot withdraw it.

Prohibited Content: Do not submit Content that infringes intellectual property rights, is misleading, or breaks the law. Gabagoolio may remove Content that violates these Terms. You confirm you have permission to share your references’ contact details.

Listings and Estimates

Listings come from employers’ careers pages, job listing services, property managers’ listing pages and other third-party sources. They may be inaccurate, incomplete or out of date, and a job or rental may already be taken. Gabagoolio does not verify or endorse any employer, landlord or Listing.

Commute times, routes, crime figures, housing figures and match rankings are estimates for guidance only. Confirm anything you rely on with the employer or another primary source.

No Employment Relationship

Gabagoolio is not an employer or an employment agency and does not act for any employer. The Service does not guarantee interviews, offers or employment. Employers alone make hiring decisions.

Intellectual Property

The Service, including its software, designs and text, is owned by Gabagoolio or its licensors. Map data is © OpenStreetMap contributors. No rights are granted to you except as stated in these Terms.

Fees

The Service is free. Gabagoolio may offer paid features in the future under separate terms presented before any purchase.

Service Modifications and Discontinuation

Gabagoolio may change, suspend or discontinue any part of the Service at any time. We will try to give notice before removing a major feature.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. GABAGOOLIO DOES NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE SERVICE, THAT LISTINGS OR ESTIMATES ARE ACCURATE, THAT ANY APPLICATION WILL BE SUBMITTED OR SUBMITTED CORRECTLY, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GABAGOOLIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, ARISING FROM:

  • YOUR ACCESS TO OR USE OF THE SERVICE;
  • FAILURE OF THE SERVICE TO SUBMIT AN APPLICATION, OR AN APPLICATION SUBMITTED LATE, INCOMPLETE OR WITH INCORRECT ANSWERS, FOR ANY REASON;
  • ANY ACTION OR INACTION OF EMPLOYERS OR OTHER THIRD PARTIES;
  • ANY INACCURACIES OR OMISSIONS IN LISTINGS, COMMUTE TIMES, CRIME OR HOUSING INFORMATION, OR OTHER INFORMATION PROVIDED BY THE SERVICE.

IN NO EVENT WILL GABAGOOLIO’S TOTAL LIABILITY EXCEED $100.

Indemnification

You agree to indemnify Gabagoolio against third-party claims arising from false Content you provide or your violation of these Terms.

Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration under the American Arbitration Association Consumer Arbitration Rules. The hearing will be held remotely or in the county where you live. Gabagoolio pays all filing and arbitrator fees for claims under $10,000. Either party may bring an individual claim in small claims court instead. Before filing, the claimant must email a description of the claim to the other party and allow 30 days to resolve it. If 25 or more similar demands are filed by or with the same counsel, the AAA Mass Arbitration Supplementary Rules apply, and the demands will be administered in batches of 25. You and Gabagoolio waive any right to a class action or class-wide arbitration. Nothing here waives your right to seek public injunctive relief in court. If the class action waiver is found unenforceable for a claim, that claim proceeds in court, not in arbitration. You may opt out of this section by emailing support@gabagoolio.com within 30 days of first agreeing to these Terms.

Governing Law and Jurisdiction

Washington law governs these Terms, without regard to conflict-of-law rules. Any claim not subject to arbitration must be brought in the state or federal courts in King County, Washington, or in the courts of the county where you live.

Modifications to These Terms

We may update these Terms. Material changes take effect 14 days after we email you about them. Other changes take effect when posted. Continued use after a change takes effect means you accept it. A change does not apply to a dispute already notified to the other party.

Termination

Gabagoolio may suspend or terminate your access to the Service immediately and without notice if you breach these Terms. You may stop using the Service at any time and delete your account with Delete my account in Account settings. The Content and Applications, Disclaimer of Warranties, Limitation of Liability, Indemnification, Arbitration and Class Action Waiver, and Governing Law and Jurisdiction sections survive termination.

Miscellaneous

  • Entire Agreement: These Terms and the Privacy Policy are the entire agreement between you and Gabagoolio about the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions stay in effect.
  • Waiver: A failure to enforce any provision is not a waiver of it.
  • Assignment: You may not assign these Terms without our prior written consent. Gabagoolio may assign them without notice.
  • Electronic Notices: You agree that notices we send by email satisfy any requirement that they be in writing.
  • Third-Party Sites: Links to employer and other third-party sites are governed by those sites’ terms, and Gabagoolio is not responsible for them.
  • Non-Waivable Statutory Rights: Nothing in these Terms limits rights that applicable law does not allow to be waived.
